CHENNAI: Policemen staging fake encounters should be sent to the gallows, Justice Katju has said. Equally, persons making honour killings deserved the capital punishment, he added. The policemen were to protect the people. They could not kill the accused under the pretext of encounter. They could not violate Article 21 of the constitution, which enshrined right to life and liberty. Police could not take law into their own hands. Will a policeman com mit the heinous crime of rape or decoity as per instructions of higher ups? he asked and added that it would be very dangerous if the policemen were given such a power. He described the act of honour killing as barbaric. If a daughter, a major one, wanted to marry a man belonging to another religion or caste, the father and his relatives could at best cut off their relationships with her, Justice Katju said, and added that such killing would not be acceptable to the modern society. As regards sex-workers, numbering three million in India, Katju said that because of terrible poverty they had come into the flesh trade.
