HYDERABAD: With the Emaar case reaching pre-trial stage, CBI on Friday filed a memo in court, seeking permission to prosecute IAS officers BP Acharya (suspended) and LV Subrahmanyam (TTD EO) under various sections of the IPC.It urged the court to take cognizance of offences allegedly committed by the two under various sections of IPC but court did not oblige it in the absence of the central government’s sanction for prosecution of two bureaucrats if cases are registered against them under the Prevention of Corruption Act.In its chargesheet filed on August 17, 2011, the CBI named Acharya as accused no 1 and charged him under Sections 120-B read with 420, 409, 477-A of IPC and Section 13 (2) r/w 13 (1) (c ) and (d) of Prevention of Corruption Act. Similarly, Subrahmanyam was charged under Section 120-b of IPC and also under PC Act.The CBI wants to prosecute the two under IPC and drop the charges under PC Act till sanction is obtained.
