Moily blames former CJI for Bhopal mess-up
The Union Law minister said the judiciary was slow and reduced the Bhopal disaster into a truck accident.

New Delhi: The Union Law Minister Veerappa Moily has absolved the Central government of the Bhopal mess-up and in stead, blamed the judiciary saying it has reduced the case into a truck accident.

Moily while critising the judiciary for being slow, said the former Chief Justice of India Justice A H Ahmadi diluted the charges against the UCIL.

Meanwhile, Justice Ahmadi has offered to quit as the Bhopal Memorial Hospital trust chairman. He said he would send his resignation to the CJI after allegations of conflict of interest.

The minister blamed the judiciary directly for the Bhopal mess-up, saying it is the judiciary and not the executive that is to blame. However, he did not name Justice Ahmadi. He alleged the judiciary was slow and treated the Bhopal gas leak like a truck accident.

Moily says it's unfortunate that the court changed the charges from that relating to culpable homicide not amounting to murder to 304 A (that of causing death by negligence). Justice Ahmadi was the then Chief Justice of the Supreme Court of India.

Moily also criticised former Prime Minister Rajiv Gandhi's Principal Secretary P C Alexander, saying he was making false charges against Gandhi as he could not become the President of India.

"It is the judiciary and not the executive that is to blame for the Bhopal mess," Moily said, adding "the judiciary was slow and treated the tragedy like a truck accident."

Moily said: "It is unfortunate that the court changed the charges from 304 (culpable homicide not amounting to murder) to 304 A (causing death by negligence). Man-made disasters cannot be treated as accidents."

Justice Ahmedi was sharply criticised for his controversial judgment which diluted the charges against the accused. Critics were citing conflict of interest in Ahmadi heading the Bhopal Memorial Hospital Trust, set up by the Supreme Court with money given by the Union Carbide, after his retirement.
