HYDE: Terming Yakub Reddy's case as extraordinary, a division bench of the High Court comprising justice Ghulam Mohammed and justice KG Shankar on Thursday directed the Central Bureau of Investigation (respondent number 17), to probe the unlawful and illegal actions of gross physical abuse and custodial torture committed by the Warangal superintendent of police, two DSPs, Subedari police station house officer, circle inspectors and subinspectors.
Dealing with a writ petition filed by V Yakub Reddy, the division bench said in its order that it would deem it appropriate to direct the CBI to register a case and cause an investigation forthwith. "It is evident from the judgement of the Supreme Court in the Sakiri Vasu v state of Uttar Pradesh case that this court should ordinarily refuse to interfere in such matters and relegate the petitioner to his alternative remedy, first under Section 154 (3) and Section 36 of the CrPC before the police officers concerned and, if that is of no avail, to approach the magistrate concerned under Section 156 (3). But the case on hand is an extraordinary one," it observed."Having regard to the peculiar facts and circumstances of the case, pending answer to the reference and also pending disposal of the writ petition, we deem it appropriate to direct the CBI, represented by the its director, to register a case and investigate into the unlawful, illegal actions of gross physical abuse and custodial torture forthwith,'' it said.

Yakub Reddy (35), leader of Warangal district Telangana students' union, was severely injured in police lathicharge when he organised a protest (dappu chappudu) in front of the residence of IT minister Ponnala Lakshmaiah during the Sakala Janula Samme. A case was registered against DSP Venkata Narasaiah on the charge of beating up Yakub.

He also prayed the court to direct the government to defray the expenses incurred by him towards medical and hospital costs, and to provide protection to his life.
