New Delhi: The Supreme Court will scrutinise documents relating to the change of designated CBI judges trying the fodder scam cases involving Railway Minister Lalu Prasad at Patna.
If the apex court deems fit, the bench comprising Justices SN Variava, AR Lakshmanan and SH Kapadia will pose queries to the Patna High Court on October 26, the next date of hearing.
Documents received from the High Court relate to the promotion of designated CBI Judge Yogendra Prasad and the appointment of Munni Lal Paswan in his place to try the fodder scam cases.
The court was hearing a PIL filed by JD (U) leader Rajiv Ranjan Singh 'Lallan' and BJP MP Sushil Kumar Modi.
They had challenged the quashing of income tax cases against Prasad and his wife Rabri Devi while seeking stay on the transfer of the Special CBI Judge hearing disproportionate assets cases against the couple.
Prasad has been accused of interfering in the ongoing trial of multi-crore fodder scam cases and the Government of not pursuing the income tax cases due to his position in the UPA Government.
An Income Tax Appellate Tribunal had quashed the tax demands made by the Department against Prasad and his wife running into lakhs of rupees.
But the CBDT did not give clearance for filing of appeals against the Tribunal order.
Prasad had contended that the PIL was not maintainable and was an abuse of the process of law.
