New Delhi: In a setback for the Aam Aadmi Party government, the Supreme Court has stayed the Delhi High Court's observations which said that the Lieutenant Governor has no power in posting and transfer of bureaucrats.
The apex court has said that the High Court observations will not have any bearing on the case filed by the Delhi government challenging the Home Ministry notification. The SC has asked the Delhi government to reply within three weeks.
The SC has also issues notice to the Delhi government on Centre's appeal against HC order allowing the Anti-Corruption Branch of Delhi to take action against bureaucrats.
After the Delhi High Court termed the Home Ministry notification on Lieutenant Governor's powers as suspect, the Centre moved the Supreme Court via a Special Leave Petition. The Centre has claimed that the order has left the equation between the L-G and Delhi government in 'total uncertainty'.
Reacting to the SC observation, AAP leader Somnath Bharti said that it is unlikely that the court has stayed a court's observation. "Never heard SC stay a High Court order. We will see the order. It is not a setback for AAP but a setback for the people of Delhi. It is unfortunate if at all the central government tries to save the corrupt officers on the basis of this order," he said.
