CUTTACK: In a bid to implement the Right of Access to Justice, the division bench of the Orissa High Court, comprising Chief Justice V Gopalagowda and Justice BN Mohapatra, on Thursday accepted a petition signed by more than 200 persons residing at Nua Sahi of Bidanasi area in Cuttack city and directed CDA not to evict them till December 3. The bench further directed the counsel for CDA to produce all details on the status of the land on that day. According to petitioners, of which nearly 10 persons including four women, who were present before the court stated that they had been staying there since long. They alleged that the IIC of Bidanasi police station on Thursday instructed them to vacate the place or else they will be evicted on Friday by use of force as per the court’s order. The course of hearing on the issue, however took another turn when an advocate Pradeep Kumar Mohapatra sought the permission of the court to intervene in the matter. Permission granted, he submitted that these petitioners were encroachers and had illegally constructed their houses. Some unscrupulous and anti-social elements have facilitated construction of their houses by giving them protection after getting huge amount of money from them. By that process they are obstructing other genuine residents in many ways. He further stated that his brother Govind Chandra Mohapatra has submitted a representation to the Collector for appropriate action. Since then he is being threatened by those elements to withdraw the complaint or face dire consequences. Considering such submission, the court has observed that this aspect would be inquired into by the Crime Branch and appropriate directions shall be issued for taking further action.
