The Delhi High Court on Thursday dismissed a PIL seeking probe against a 1977 batch IAS officer for allegedly furnishing wrong information, including his nationality, at the time of appointment.
A division bench of Chief Justice D Murugesan and Justice Jayant Nath dismissed the plea against IAS officer Subhash Kumar, saying "it is a service matter and PIL cannot be entertained".
"The present matter is akin to a service matter though the petitioner has not sought a writ of quo-warranto. A PIL is normally not maintainable in service matters.
Hence, the present writ is not maintainable," the bench said. "We are not inclined to interfere in the findings of the fact recorded by the Centre.
Nothing has been placed on record to show that the said findings recorded by Union of India are erroneous on the face of it. We don't propose to exercise any appellate power to interfere with the recording of the facts and findings," the court said.
Kumar is presently posted in Uttarakhand and is due to retire next year. The plea was filed by Dileep Kumar Singh Bisht who sought an investigation by an independent agency into the allegations.
Claiming to have obtained details about Kumar through RTI applications, Bisht had alleged that Kumar was a Tibetan refugee and had submitted false declarations and prepared forged documents including his caste certificate
