New Delhi: The Supreme Court on Monday issued a contempt notice to the Home Secretary and the Director General of Police of Uttar Pradesh for allegedly not complying with its order of reinstatement of all 19,000 police constables whose jobs were terminated by the government in 2007.
A bench of Justices D K Jain and H L Dattu directed the top officials to file its reply within eight weeks on why the order of reinstatement passed by the Supreme Court in 2009 has not been complied with.
The bench said the two officials will have to be personally present in the court if they fail to respond to the court's notice in due time.
"Show cause as to why action for not complying with the order dated December 16, 2009, be not initiated against them," the bench said while hearing a contempt petition filed by two sacked constables.
"The authorities have acted in arbitrary and discriminatory manner by refusing to grant appointment to all selected candidates (including the petitioners) though all of them are similarly placed," advocate Praveen Agrawal, appearing for the constables, said.
Around 19,000 police constables were appointed in 2005 during Mulayam Singh Yadav's tenure as Chief Minister but they were sacked shortly after Mayawati took over the reins of in the state in 2007.
