Sales of iPods account for almost a third of Apple's sales. But with the credit card-sized nano now facing customers? criticism, Apple?s market share might be in question.

New Delhi: For the second time in its history, a class action lawsuit has been brought against the Apple ipod.

Problems for Apple began when users started grumbling that the device's screen scratches too easily.

Jewellery designer Arunima Sahu, says she listens to music almost all the time, except when she's talking to someone or in a meeting.

So, buying Apple's iPod Nano seemed to make a lot of sense.

"It's light, small, good looking and easy to carry around and use," she tells IBN correspondent, Narendra Nag.

But like other owners all over the world, she quickly discovered that the sexiest iPod ever got ugly in double quick time.

"Any gadget, which is good looking, scratched in two days is kind of depressing," says Sahu.

The depression cuts across borders as a class-action lawsuit filed in Philadelphia alleges that the company knew its nano portable music player was defective but still decided to press on with the product's release last month.

While the lawsuit has been filed in America, cyber law expert Pawan Duggal suggests Indian owners of the Nano stand to benefit.

"Whether apple wins or loses, its a win-win situation for the customer,? says Duggal.

The last time Apple got sued over bad batteries in iPods, they ended up settling out of court and giving replacement vouchers to users.

For Nano owners like Arunima, Apple's past may suggest a happy, scratch free, future.
