Aarushi case: CBI tells SC Nupur won't be arrested

New Delhi: In a major relief for murdered teenager Aarushi Talwar's mother Nupur Talwar, the Central Bureau of Investigation (CBI) told the Supreme Court on Friday that even though the investigating agency was aware of her whereabouts, yet she was not arrested as her application for the cancellation of the non-bailable warrant against her was pending before the apex court.

Even though a non-bailable warrant has been issued by the trial court in Ghaziabad against Nupur Talwar, the CBI counsel assured the Supreme Court that there was no plan to arrest her. The bench hearing the petition said that court had full faith in the CBI.

Earlier, after being untraceable for over two days Nupur Talwar finally made an appearance in the Supreme Court on Friday. The CBI had been hunting for Nupur Talwar to arrest her after a non-bailable warrant was issued against her. The CBI chose not to arrest Nupur Talwar before she was entering the courtroom.

Nupur Talwar's lawyer Mukul Rohatgi had on Thursday moved the Supreme Court to cancel the non-bailable warrant against her. After the CBI's assurances to the court Rohatgi said that the Chief Justice of India would decide which bench would hear the matter.

"CBI fairly said that Dr. Talwar will not have any problem. The matter will be heard next week," said Rohatgi.

If the court rejects her plea, the CBI can arrest Nupur Talwar right after the court hearing is over.

After the Ghaziabad court issued the non-bailable warrant, the CBI had carried out raids in Noida and Delhi in the past two days, looking for Nupur Talwar.

Nupur Talwar had failed to appear before a special CBI court on Wednesday despite a deadline given to her, following which the CBI asked the court to issue a warrant against her. Aarushi's father Dr Rajesh Talwar was present in court for the hearing on Wednesday.

Rajesh Talwar and his wife Nupur have been accused by the CBI of being involved in the murder of their teenaged daughter Aarushi in May 2008.

Aarushi, 14, was found dead inside her Noida residence in May, 2008 with her throat slit and the body of the Talwars' domestic servant Hemraj was recovered from the terrace hours later.

An outcry against the shoddy investigation by Uttar Pradesh police had led to the then Mayawati government in Uttar Pradesh handing over the case to the CBI.
